The submission of a Sweepstakes entry (online or Form) constitutes your (&, if an eligible minor, your parent’s or legal guardian’s) consent to participate in this Sweepstakes & your (&, if an eligible minor, your parent’s or legal guardian’s) consent for Sponsor to obtain, use, & transfer your name, address & other information for the purpose of administering this Sweepstakes & as otherwise specified herein. Released Parties are not responsible for lost, incomplete, illegible, incorrect, delayed, undelivered, misdirected, late, stolen, postage-due, or mutilated entries, Forms, or mail; theft, destruction or unauthorized access to, or alteration of, entries or Forms; failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from Sweepstakes participation; typographical, printing or other errors or omissions in these Official Rules, in any Sweepstakes-related advertisements or other materials; human-processing error; or other problems or errors of any kind whether computer, network, mechanical, human, electronic, typographical, printing, downloading, or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, in the processing of entries & Forms, in the selection or announcement of the winner or in the awarding of the prize. Sponsor reserves the right, in its sole discretion, to void any & all entries of an entrant (& disqualify such entrant) who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes or who is otherwise in violation of these Official Rules. Winner Selection: Potential winner will be selected in a random drawing on or about 8/21/08 from all eligible entries received by P/S/T, an independent judging organization whose decisions are final & binding in all Sweepstakes matters. Potential winner will be notified by P/S/T by email. The name of the “authorized account holder” associated with any given email address will be deemed to be the entrant & must comply with & abide by these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor, in Sponsor’s sole discretion. If a dispute as to the identity of the authorized account holder or the potential winner cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. If an eligible minor is selected as the potential winner, prize will be awarded in the name of said minor’s parent or legal guardian & applicable parent or legal guardian will be required to accompany said minor on the Grand Prize trip & otherwise fulfill all requirements imposed on winner set forth herein. Odds of winning will depend on the number of eligible entries received. (1) Grand Prize: A 3-day/2-night trip to New York City for winner & up to (3) three guests including a 2008 NY Yankees™ regular season home game designated by Sponsor & the opportunity to meet Derek Jeter. Prize includes round-trip coach air transportation from the nearest major airport to winner’s residence in the U.S., (2) standard double-occupancy hotel accommodations (room & tax only), (4) tickets to the designated game, & ground transportation to/from the airport & the applicable hotel (Approximate Retail Value “ARV”=$4,200). Actual prize value will vary depending on winner’s city of departure & final flight itinerary. Exact seat locations at designated game & the date, nature & duration of Derek Jeter meet & greet to be determined solely by Sponsor. Trip must be taken on dates specified by Sponsor or prize will be forfeited & Sponsor will have no further obligation to winner. If any prize-related activity(s) is canceled or postponed for any reason, no compensation or substitution shall be provided; however, balance of prize will be awarded in full satisfaction of prize award. Travel & hotel accommodation restrictions apply. Travel arrangements must be made through Sponsor’s agent & on a carrier of Sponsor’s choice. Sponsor, in its sole discretion, reserves the right to provide ground transportation in lieu of air transportation if Sponsor determines that winner resides within a reasonable driving distance of New York City. Minor guest(s) (if any) must be accompanied by his/her parent or legal guardian, & winner & guests must travel together on the same itinerary. Winner & his/her guests are responsible for obtaining all necessary travel documentation. Winner & his/her guests agree to comply with all Yankee Stadium™ rules & regulations relating to the use of game tickets &, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at the designated game. Winner & guests will be escorted out of said game by Sponsor or its designated agent(s) for improper conduct and/or violation of federal, state or local laws & will forfeit the balance of his/her prize. Prize details are at Sponsor’s sole discretion. Federal, state, & local taxes & all other costs & expenses associated with prize acceptance & use not specified herein as being provided & associated IRS Form 1099-MISC submission as required by law are winner’s sole responsibility. Miscellaneous: No transfer, assignment, cash redemption, or substitution of the prize (or portion thereof) except by Sponsor for a prize (or applicable portion thereof) of comparable or greater value, at its sole discretion. Potential winner (if a minor, his/her parent or legal guardian) will be required to execute & return a notarized Affidavit of Eligibility, Liability Release & (where legal) Publicity Release within (5) days of date of issuance of notification. Guests (if a minor, their respective parent or legal guardian) will be required to sign & return a notarized Liability Release & (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification & awarding of the prize to an alternate winner as determined by Sponsor. If any prize notification letter is returned as undeliverable or Sponsor is unable to contact potential winner within a reasonable time period, potential winner will be disqualified & an alternate winner may be selected, at Sponsor’s sole discretion. By participating, entrants (if a minor, their respective parents or legal guardians) agree to be bound by these Official Rules & the decisions of Sponsor & judges which are final & binding & agree that: 1) Released Parties & their designees & assigns shall have the right & permission to use (unless prohibited by law) their name, voice, city/state of residence, biographical information, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format, online or offline, now or hereafter known worldwide in perpetuity, without further compensation, permission, or notification; & 2) Released Parties & their designees & assigns shall have no liability & will be held harmless for any claim, liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including any travel or prize activity related thereto) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to disqualify any entry & to modify, terminate or suspend this Sweepstakes should virus, bugs, non-authorized human intervention, action of entrants, or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes &, if the Sweepstakes is terminated, select the winner from those eligible, non-suspect entries received prior to event requiring such termination.
